29 CFR 1926.52(d)(1): The employer did not administer a continuing, effective hearing conservation program where sound levels exceed the values shown in Table D-2 of 29 CFR 1926.52: a) On site at Wayfair, 159 Crown Court, Oakdale, PA. On or about March 11, 2025, the employer did not administer an effective hearing conservation program where sound levels exceed the values shown in Table D-2 of 29 CFR 1926.52. An employee designated as a Laborer was exposed to noise at a level of 140.3% of the allowable limit during a 285 minute sampling period on March 11, 2025. This exposure is equivalent to a sound level of 92.4 dBA for the dose and time of employee exposure and is 1.4 times in excess of the 90 dBA (100%) at which the hearing conservation program is required.

29 CFR 1926.1153(c)(1): For each employee engaged in a task identified on Table 1, the employer shall fully and properly implement the engineering controls, work practices, and respiratory protection specified for the task on Table 1, unless the employer assesses and limits the exposure of the employee to respirable crystalline silica in accordance with paragraph (d) of this section: a) On site at Wayfair, 159 Crown Court, Oakdale, PA. The employer did not implement engineering controls, work practices and respiratory protection as specified for the tasks in Table 1 of the Respirable Crystalline Silica standard when the employer did not assess the employee's exposure limits. Employees of the facility were operating a walk-behind saw in an enclosed area and were not wearing respiratory protection with an assigned protection factor (APF) of 10.
