29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his work environment to control or eliminate any hazards or other exposure to illness or injury: a) Job site, 1221 Penn Avenue, Pittsburgh, PA: On or about September 9, 2025 during drilling activities, the employer did not ensure an employee was provided with trench and excavation safety training. Deficiencies noted during the inspection included, but were not limited to, failing to use cave in protection in an excavation at least 5 feet deep, no safe means of egress being utilized in one end of the excavation and no actions being taken to prevent items such as broken concrete in the sidewalls from falling down onto the employee.

29 CFR 1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could result in possible cave-ins, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions, prior to the start of work and as needed throughout the shift, and after every rainstorm or other hazard increasing occurrence: a) Job site, 1221 Penn Avenue, Pittsburgh, PA: On or about September 9, 2025 during drilling activities, the employer did not ensure the excavation being worked in was inspected by a competent person prior to working in it. Deficiencies noted during the inspection included, but were not limited to, failing to use cave in protection in an excavation at least 5 feet deep, not providing a safe means of egress in one end of the excavation and no actions being taken to prevent items such broken concrete in the sidewalls from falling down onto the employee.
