29 CFR 1910.28(b)(2)(i): The employer did not ensure that each employee in a hoist area is protected from falling 4 feet (1.2 m) or more to a lower level by one of the systems listed in 29 CFR 1910.28(b)(2)(i)(A)-(C).  On or about February 13, 2025, in phase 2 mixing rooms the employer failed to ensure that when batchers removed guardrail sections to facilitate mixer loading activities were protected from a fall greater than 4ft. Batchers were exposed to a fall onto a hard surface while they facilitated mixer loading activities.

29 CFR 1910.134(c)(2)(i): Respirator users were not provided with the information contained in Appendix D to 29 CFR 1910.134 when the employer determined that any voluntary respirator use was permissible:  On or about and times prior to March 24, 2025, the employer failed to provide voluntary users of KN95 filtering facepiece respirators with the information contained in Appendix D to 29 CFR 1910.134. Voluntary users of KN95 filtering facepiece respirators were unaware of the respirator's limitations when exposed to nuisance dust in dryer rooms.

29 CFR 1910.147(c)(4)(i): Procedures were not developed, documented and utilized for the control of potentially hazardous energy when employees were engaged in activities covered by this section:  On or about March 13, 2025, in the mixing rooms, hazardous energy control procedures were not developed when operators or batchers engaged in covered maintenance and servicing activities on the Sani Matic filter(s). Maintenance and servicing performed included but were not limited to setup, cleaning and replacement of filters. Employees were exposed to struck-by hazards from residual energy left inside the filter line.

29 CFR 1910.147(c)(4)(ii): Procedures did not clearly and specifically outline the scope, purpose, authorization, rules, and techniques to be utilized for the control of hazardous energy, and the means to enforce compliance including, but not limited to, 29 CFR 1910.147(c)(4)(ii)(A), (c)(4)(ii)(B), (c)(4)(ii)(C) and (c)(4)(ii)(D):  On or about and times prior to March 24, 2025, the employer did not ensure that the energy control procedure addressed all potentially hazardous energy sources for employees who perform servicing operations on equipment such as, but not limited to, the Phase 2 Homogenizer. Servicing operations included, equipment tear down and sanitation. Noted deficiencies included, but may not be limited to, the following:  (1) Specific procedural steps for shutting down, isolating, blocking and securing machines or equipment to control hazardous energy pursuant to 1910.147(c)(4)(ii)(B). The procedure did not specifically address controlling the Homogenizer's pneumatic energy source prior to performing service and maintenance activities on equipment.
