29 CFR 1926.28(a): Appropriate personal protective equipment was not worn by employee(s) in all operations where there was exposure to hazardous conditions. On or about March 18, 2025, located on the median of 13th St. and N. Broadway St., employees performing backfill operations at an excavation site were opperating a backhoe loader and were not in use of the seatbelt.

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652 (b) or (c). On or about March 18, 2025, located in the median of N. Broadway St., employees were performing waterline installation work activities in an excavation wiht unprotected sides that were more than five (5) feet deep and no protective systems in place. Luckinbill Construction Co., was previously cited for a violation of this Occupational Safety and Health standard, 29 CFR 1926.652(a)(1), which was contained in OSHA inspection number 1684403, citation number 01, item number 01, and was affirmed as a final order on January 5, 2024, with respect to a workplace located at 2400-2466 N. Van Buren St, 36.42050N, -97.89072W, Enid, OK. 73703.
