29 CFR  1926.100(a):Employees were not protected by protective helmets while working in areas where there was a possible danger of head injury from impact, or from falling or flying objects, or from electrical shock and burns.  Location: Worksite  On or about March 19, 2025, employees were exposed to struck-by hazards while working on, and below, fabricated frame scaffolding, while other employees, along with unsecured scaffold components, materials, and tools could fall on employees and cause head injury from impact, where the employer did not ensure that employees were protected by protective helmets.  The employer has previously been cited for not ensuring that employees wore protective helmets, as noted below:  a) JOHN WILLIAM MASONRY BRS, LLC was previously cited for a Serious violation of this occupational safety and health standard or its equivalent standard, 1926.100(a) which was contained in OSHA inspection number 1482471, citation number 1, item number 1 and was affirmed as a final order on 1-4-2021, with respect to a workplace located at 10 Charlesgate East, Boston, MA 02115.

29 CFR  1926.451(e)(1):When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from other scaffold, structure, personnel hoist, or similar surface was not used. Crossbraces were used as a means of access.  Location: Worksite  On or about March 19, 2025, employees were exposed to fall hazards of over 40 feet while climbing framed sections of the fabricated frame scaffolding being used on site, where the employer did not ensure that proper access to each level of the scaffold was in place, by any means.

Location: Worksite  On or about March 19, 2025, employees were exposed to fall hazards of over 40 feet while erecting and dismantling the fabricated frame scaffolding used on site to perform the new copper downspout installation, where the employer did not ensure that trained employees erected and dismantled the scaffolding under the supervision and direction of a competent person.  The employer has previously been cited for not ensuring that a competent person oversaw work, as noted below:  a) JOHN WILLIAM MASONRY BRS, LLC was previously cited for a Repeat-Serious violation of this occupational safety and health standard or its equivalent standard, 1926.20(b)(2) which was contained in OSHA inspection number 1482471, citation number 2, item number 1 and was affirmed as a final order on 1-4-2021, with respect to a workplace located at 10 Charlesgate East, Boston, MA 02115.  b) JOHN WILLIAM MASONRY BRS, LLC was previously cited for a Serious violation of this occupational safety and health standard or its equivalent standard, 1926.20(b)(2) which was contained in OSHA inspection number 1397997, citation number 1 , item number 1 and was affirmed as a final order on 9-18-2019, with respect to a workplace located at 121 Portland Street Boston MA.

Location: Worksite  On or about March 19, 2025, employees were exposed to fall hazards of over 40 feet while working from the fabricated frame scaffolding in order to install the new copper downspout, where the employer did not ensure that employees had been trained by a qualified person in order to be able to recognize the hazards associated with the fabricated frame scaffolding being used and to understand the procedures to control or minimize those hazards.
