29 CFR 1910.138(b): The employer did not base selection of appropriate hand protection on an evaluation of the performance characteristics of the hand protection relative to the tasks to be performed, conditions present, duration of use, and the hazards and potential hazards identified: Level Winding Machine #1 and #2: On or about March 13, 2025, and at times prior thereto, employees were working with metal banding straps and cutting copper tubing without cut-resistant gloves.

29 CFR 1910.212(a)(1): One or more methods of machine guarding was not provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks: Level Winding Machine #1 and #2: On or about March 13, 2025, at times there prior to, employees operated the Level Winding machines without guards to protect from the ingoing nip point while guiding copper wire/tubing with their hands as it was being wound onto a spinning spool. Hailiang Copper Texas Inc was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1910.212(a)(1), which was contained in OSHA inspection number 1738003, citation number 01, item number 16, and was affirmed as a final order on October 18, 2024, with respect to a workplace located at 5000 IH-10, Sealy, TX 77474.
