OSH ACT of 1970 Section (5)(a)(1):The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that the employer utilized damaged storage rack systems, exposing employees to struck-by and crushing hazards. (a) Located at 3321 Toy Road, Groveport, Ohio, 43125: On or about March 25, 2025 and times prior, the employer failed to ensure that the storage racks located at or near 11-23-01-B, 03-55-02-A, 02-51-01-B, and 02-43-01-A were free from column deflection damage ranging from 1/2 inch to approximately 2 inches. (b) Located at 3321 Toy Road, Groveport, Ohio, 43125: On or about March 25, 2025 and times prior, the employer failed to ensure that the storage rack located at or near 13-24-02-B was free from damage were the row spacer had been broken and bent which caused it to detach from the bolt connecting it to the racking system. (c) Located at 3321 Toy Road, Groveport, Ohio, 43125: On or about March 25, 2025 and times prior, the employer failed to ensure that the storage rack located at or near 14-27-01-A was free of twisted footplates of approximately 1 inch. (d) Located at 3321 Toy Road, Groveport, Ohio, 43125: On or about March 25, 2025 and times prior, the employer failed to ensure that the storage racks located at or near 14-28-02-A, A, and 07-56-01-A were free from damage from broken welds on the strut supports of the racking system.

The attachment point may be located in the pre-sternal position if the free fall distance is limited to 2 feet (0.6 m) or less. a. Located at 3321 Toy Road, Groveport, Ohio, 43125: On or about March 25, 2025: The employer failed to provide an employee with properly fitting fall protection equipment that positioned the attachment point of the body harness at the center of the back while the employee was operating an order picker at heights exceeding ten feet above ground level.
