29 CFR 1926.501(b)(10): Each employee engaged in roofing activities on low-slope roofs with unprotected sides and edges 6 feet or more above lower levels, was not protected from falling by guardrail systems, safety net systems, personal fall arrest systems, or a combination of warning line system and guardrail system, warning line system and safety net system, or warning line system and personal fall arrest system, or warning line system and safety monitoring system. Or, on roofs 50-feet (15.25 m) or less in width, each employee was not protected by use of a monitoring system:  a) On or about 03/27/2025 at the site located at 5428 North Burdick Street, Fayetteville, New York: Employees were applying a new roof system on flat roof without the use of fall protection. Employees were exposed to falls of approximately 8 to 24 feet.  Kris O'Connor DBA O'Connor Contracting was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(10), which was contained in OSHA inspection number 1724943, citation number 1, item number 1 and was affirmed as a final order on 1/10/2025,with respect to a workplace located at 950 Broadway Street, Buffalo, New York.

29 CFR 1926.503(c)(3): Inadequacies in an affected employee's knowledge or use of fall protection systems or equipment indicate that the employee has not retained the requisite understanding or skill:   a) On or about 03/27/2025 at the site located at 5428 North Burdick Street, Fayetteville, New York: Employees did not utilize fall protection showing the employees did not retain the appropriate understanding for the use of fall protection. Employees were exposed to fall hazards of approximately 18 feet.

29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:  a) On or about 3/27/2025 at the site located at 5428 North Burdick Street, Fayetteville, New York: Employees accessed the roof with a Werner Extension Ladder that was not extended 3 feet above the upper landing surface. Employees were exposed to a fall distance of approximately 18 feet.  Kris O'Connor DBA O'Connor Contracting was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.1053(b)(1), which was contained in OSHA inspection number 1724943, citation number 1, item number 2 and was affirmed as a final order on 1/10/2025, with respect to a workplace located at 950 Broadway Street, Buffalo, New York.
