The employer shall permit only those employees qualified by training or experience to operate equipment and machinery.  a) On or about April 01, 2025, Building Crafts Inc., at the Greater Cincinnati Water Work (Richard Miller Treatment Plant), 5651 Kellogg Avenue, Cincinnati, OH 45230, failed to ensure that employees were qualified, either by training or experience, to operate a John Deere 544K Front-End Loader (Product Identification Number 1DW544KZKB0634769) with a Pemberton Inc. Jib Attachment (Model: 414470 JD544K, Serial No.: EB-558-0417J). Specifically, the employer did not ensure that the operator verified that the loader coupler pin plate was pressed against the loader coupler structure, confirmed that the pins were fully engaged in the attachment mounting holes, confirmed that the attachment responded properly to controls, and ensured that bystanders were kept clear of raised booms, attachments, and unsupported loads, as required by the manufacturer's procedures. As a result, an employee was exposed to struck-by hazards when the Pemberton Inc. Jib Attachment detached and struck the employee, resulting in hospitalization.
