29 CFR 1926.20(b)(2):Such programs shall provide for frequent and regular inspections of the job sites, materials, and equipment to be made by competent persons designated by the employers. a) On or about November 7, 2025, the employer failed to ensure that frequent and regular inspections of the job site, materials, and equipment were conducted by a competent person. Employees were engaged in demolition activities at a water treatment facility located at 4409 Haskell Lane, Batavia, OH, involving the rigging and removal of large concrete slabs using heavy equipment. The equipment used was not rated for the load being lifted, the material being moved was not stable and as a result the slab fell during the the disposal process, resulting in serious injuries to an employee.

29 CFR 1926.21(b)(2):The employer shall instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his work environment to control or eliminate any hazards or other exposure to illness or injury. a) On or about November 7, 2025, the employer failed to instruct employees in the recognition and avoidance of unsafe conditions and the regulations applicable to their work environment. Employees were engaged in activities such as rigging and disposing of large concrete slabs at a water treatment facility located at 4409 Haskell Lane, Batavia, OH. A slab measuring 12' x 44.5" x 12" and weighing approximately 6,800 lbs. was stood upright by a skid steer on uneven gravel/blacktop and repeatedly adjusted before being rigged for disposal. The injured employee was not adequately trained in rigging procedures, as a result, employees were exposed to struck-by hazards from unstable concrete slabs. b) On or about November 7, 2025, the employer failed to instruct a skid steer operator in the recognition and avoidance of unsafe conditions and the regulations applicable to equipment operation. The operator used a skid steer that had a Rated Operating Capacity (ROC) of 3,200 lbs. to lift a concrete slab weighing approximately 6,800 lbs. at a water treatment facility located at 4409 Haskell Lane, Batavia, OH. As a result, employees were exposed to struck-by and equipment failure hazards due to overloaded machinery. Building Crafts, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.21(b)(2), which was contained in OSHA inspection number 1814999, citation number 1, item number 2 and was affirmed as a final order on June 18, 2025, with respect to a workplace located at 5651 Kellogg Avenue Cincinnati, OH 45230.
