29 CFR  1903.19(d)(1): The employer did not submit to the Agency documents demonstrating that abatement is complete for each willful or repeat violation and for any serious violation for which the Agency indicates in the citation that such abatement documentation is required.  (a) Chagos Construction failed to document abatement within 10 calendar days after the abatement date that each of the following cited violations had been corrected.  Citation 1, item 1 a repeat-serious violation of 29 CFR 1926.501(b)(13) with an abatement date of June 9, 2025.  Citation 1, item 2 a repeat-serious violation of 29 CFR 1926.1053(b)(1) with an abatement date of June 9, 2025.  Citation 2, item 1 an other-than-serious violation of 29 CFR 1926.503(b)(1) with an abatement date of June 9, 2025.  In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATIONS OF THE CORRECTIVE ACTION WORKSHEET).

29 CFR  1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b).  (a) On or about April 3, 2025, at 1146 W. Violet Dr., Oak Creek, WI 53154, employees installing a roof on a residential home with a 6:12 pitch were not using fall protection. This exposed the employee to a fall hazard of approximately 18 feet 10 inches from the roof eve to the ground below on the back (north) side of the home.  Chagos Construction was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(13), which was contained in OSHA inspection number 1629764, citation number 1, item number 2 and was affirmed as a final order on April 28, 2023, with respect to a workplace located at 810 W. South St., Oconomowoc, WI 53066.

29 CFR  1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed.  (a) On or about April 3, 2025, at 1146 W. Violet Dr., Oak Creek, WI 53154, employees were accessing the roof to conduct roofing work from a ladder on the front(south side) of the home which did not extend at least three (3) feet above the upper landing surface, exposing employees to a fall hazard of approximately 18 feet 10 inches.  (b) On or about April 3, 2025, at 1146 W. Violet Dr., Oak Creek, WI 53154, employees were accessing the roof to conduct roofing work from a ladder on the front(south side) of the home which did not extend at least three (3) feet above the upper landing surface, exposing employees to a fall hazard of approximately 9 feet 11 inches.  Chagos Construction was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.1053(b)(1), which was contained in OSHA inspection number 1629764, citation number 1, item number 3, and was affirmed as a final order on April 28, 2023, with respect to a workplace located at 810 W. South St., Oconomowoc, WI 53066.
