29 CFR  1926.416(a)(1): Employee(s) were permitted to work in proximity to electric power circuits that were not protected against electric shock by de-energizing and grounding the circuits or effectively guarding the circuits by insulation or other means.  Location: Job site;  On or about 04/04/2025, the employer allowed employees to be exposed to electric shock and/or electrocution hazards while performing roofing activities in the direct vicinity of energized electrical service lines to the residence.

29 CFR 1926.502(d)(15): Anchorages used for attachment of personal fall arrest equipment were not capable of supporting at least 5,000 pounds per employee attached.  Location:  Job site;  On or about 04/14/2025, employees were allowed to utilize temporary roof anchors which were not installed per manufacturer instructions to support 5,000lbs per employee in the following instances:   a) an anchorage point near the front of the residence had multiple missing fasteners and fasteners which were not fully secured to the anchorage point and the roof surface they were affixed to.  b) anchorage point at back of house which affixed to the hipped section of roof and ran along ridge beam had multiple missing fasteners in the leg of the anchorage point which was running along the ridge beam.  c) anchorage point installed on section of the garage/shed/ancillary building at back of the residence had only a single fastener affixed to the leg overhanging the edge of the roof. This fastener was also not fully secured and was bent back over the overhung leg at the edge of the roof.

29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards.  Location: Job site;  On or about 04/04/2025, the employer failed to ensure that employees exposed to fall hazards were properly trained to recognize the fall hazards and the procedures which needed to be followed to minimize the hazards.

29 CFR 1926.552(a)(1): The employer did not comply with manufacturer's specifications and limitations applicable to the operation of all hoists and elevators.  Location: Job site;  On or about 04/04/2025, employees were exposed to a fall while utilizing an RGC materials hoist/laddervader/shingle hoist as a ladder to gain access to the roof of the residence that was approximately 11-feet above the ground below. The use of a RGC materials hoist/laddervader/shingle hoist as a ladder goes against manufacturer instructions for the piece of equipment.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b).  The employer does not require the use of any form of fall protection during roofing work. This violation was most recently observed at the Worksite at 210 Pelham Street, Methuen, MA, where multiple employees were not protected from fall hazards between 11 and 14 feet to the ground. To abate this violation, the employer must ensure that its employees performing roofing work are protected from falls, and that no employee is allowed onto a roof more than 6 feet high without adequate fall protection.  Pursuant to 29 C.F.R. 1903.19, the employer must submit documents describing the steps it is taking to ensure compliance, including a description of how these steps protect its employees from fall hazards. (An abatement plan and periodic progress reports may also be required if the abatement period is more than 90 days).  The employer routinely fails to ensure that each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels is protected by guardrail systems, safety net system, or personal fall arrest system, and employee(s) are not provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b), as observed by CSHO on 04/04/2025, and for the multiple 1926.501(b)(10), 1926.501(b)(11), and 1926.501(b)(13) serious, and willful-serious violations of this standard by this employer:  Manny's Roofing, LLC DBA Manny's Construction Corporation, Mannny's Construction Corporation was previously cited for a Willful-Serious violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(10), which was contained in OSHA inspection number 1524554, citation number 2, item number 1-a and was affirmed as a final order on 03/09/2022, with respect to a workplace located at 253 Sheep Davis Rd., Concord, NH 03301.  Manny's Roofing, LLC DBA Manny's Construction Corporation, Mannny's Construction Corporation was previously cited for a Willful-Serious violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(11), which was contained in OSHA inspection number 1524554, citation number 2, item number 1-b and was affirmed as a final order on 03/09/2022, with respect to a workplace located at 253 Sheep Davis Rd., Concord, NH 03301.  Manny's Roofing, LLC DBA Manny's Construction Corporation, Mannny's Construction Corporation was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(13), which was contained in OSHA inspection number 1443941, citation number 1, item number 1 and was affirmed as a final order on 12/10/2019, with respect to a workplace located at 1 Corliss Hill Road, Haverhill, MA 01830.
