OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm, including severe burns, to employees in that employees were exposed to fire, flash fire, deflagration, or explosion hazards from dust collectors located inside a building:  a) Blue Line - Grinding Booth: Two dust collectors (Donaldson ECB), used to capture the combustible dust generated by grinding on cultured marble countertops, were located inside the building and not equipped with explosion protection systems, on or about April 3, 2025.  b) Blue Line - Grinding Booth: Two dust collectors (Donaldson DWS), used to capture the combustible dust generated by grinding on cultured marble countertops, were located inside the building and not equipped with explosion protection systems, on or about April 3, 2025.  c) Yellow Line - Grinding Booth: Two dust collectors (Donaldson ECB), used to capture the combustible dust generated by grinding on cultured marble countertops, were located inside the building and not equipped with explosion protection systems, on or about April 3, 2025.  d) White Line - Grinding Booth: One dust collector (Donaldson ECB), used to capture the combustible dust generated by grinding on cultured marble countertops, was located inside the building and not equipped an explosion protection system, on or about April 3, 2025.  e) White Line - Grinding Booth: Two dust collectors (Donaldson DWS), used to capture the combustible dust generated by grinding on cultured marble countertops, were located inside the building and not equipped with explosion protection systems, on or about April 3, 2025.  f) White Line - Grinding Booth: An enclosureless baghouse dust collector, used to capture the combustible dust generated by grinding on cultured marble countertops, was located inside the building and not equipped with an explosion protection system, on or about April 3, 2025. 29 CFR 1910.1000(e): Feasible administrative or engineering controls were not determined and implemented to achieve compliance with the limits prescribed in 29 CFR 1910.1000(a) through (d):  a) Blue Line - Grinding Booth: An employee was exposed to particulates not otherwise regulated (total dust) at an 8-hour time-weighted average of 31.7 milligrams per cubic meter of air, approximately 2.1 times the Permissible Exposure Limit of 15 milligrams per cubic meter of air. Sampling was performed for 476 minutes on May 22, 2025. Zero exposure was assumed for the 4 minutes not sampled. The employer did not implement feasible administrative and/or engineering controls to reduce employee exposure levels to below the calculated Permissible Exposure Limit for total dust.   ABATEMENT CERTIFICATION AND DOCUMENTATION REQUIRED   GENERAL METHODS OF CONTROL APPLICABLE IN THESE CIRCUMSTANCES INCLUDE, BUT ARE NOT LIMITED TO, THE FOLLOWING:  - Use grinders equipped with integral dust collection systems to minimize airborne particulate generation at the source.  - Utilize local exhaust ventilation (LEV) systems to capture dust directly at the point of grinding. The exhaust ducting must be positioned as close as practicable to the dust generation source and configured to effectively prevent migration of dust into the employee's breathing zone.  - Where practicable, employ wet methods (e.g., wet sanding) to suppress dust emissions during grinding operations on cultured marble surfaces.  - Implement job rotation by rotating employees into areas with lower dust levels to reduce their daily exposure.
