OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to explosion/flash fire hazards: (a) On or about January 22, 2025, employees were conducting defueling operations without bonding and grounding the fuel system inside a building. This task exposed employees to the hazards associated with flash fires and explosions.

29 CFR 1910.178(c)(2)(iv): Power-operated industrial trucks designated as DY, EE, or EX were not used in locations where volatile flammable liquids or flammable gases were handled, processed or used, but in which the hazardous liquids, vapors or gases would normally be confined within closed containers or closed systems from which they could escape only in case of accidental rupture or breakdown of such containers or systems, or in the case of abnormal operation of equipment; also in locations in which hazardous concentrations of gases or vapors are normally prevented by positive mechanical ventilation but which might become hazardous through failure or abnormal operation of the ventilating equipment; or in locations which are adjacent to Class I, Division 1 locations, and to which hazardous concentrations of gases or vapors might occasionally be communicated unless such communication is prevented by adequate positive-pressure ventilation from a source of clear air, and effective safeguards against ventilation failure are provided: (a) On or about January 22, 2025, employees were exposed to explosion/flash fire hazards while using type D forklift in the class I division 2 CNG facility while employees worked on compressed natural gas (CNG) trucks that were pressurized with CNG in a closed circuit system.

29 CFR 1910.307(c): Electrical installations. Equipment, wiring methods, and installations of equipment in hazardous (classified) locations shall be intrinsically safe, approved for the hazardous (classified) location, or safe for the hazardous (classified) location. (a) On or about January 22, 2025, the employer did not ensure employees tasked with defueling compressed natural gas (CNG) trucks, performed the task in a facility with electrical installations not approved for a hazardous atmosphere. This exposes the employees to explosion/flash fire hazards when releasing CNG in the vicinity of class I division 2 electrical.

1910.101(b) "Compressed gases." The in-plant handling, storage, and utilization of all compressed gases in cylinders, portable tanks, rail tankcars, or motor vehicle cargo tanks shall be in accordance with Compressed Gas Association Pamphlet P-1-1965, which is incorporated by reference as specified in Sec. 1910.6. 29 CFR 1910.1200(h)(3)(iii): The measures employees can take to protect themselves from these hazards, including specific procedures the employer has implemented to protect employees from exposure to hazardous chemicals, such as appropriate work practices, emergency procedures, and personal protective equipment to be used. (a) On or about March 12, 2025, and at times prior, the employer did not ensure employees and managers defueling compressed natural gas (CNG) trucks utilized the (CNG) defueling procedure, and were trained on the procedure. This exposed employees to explosion/flash fire hazards when defueling compressed natural gas (CNG) trucks in an ungrounded method.
