29 CFR 1910.147(c)(4)(i): Procedures were not developed, documented and utilized for the control of potentially hazardous energy when employees were engaged in activities covered by this section: (a)Mueller Pallets, L.L.C. at 801 Prairie Street, Harrisburg, SD 57032: On or about and at times prior to April 9, 2025, the employer did not ensure procedures were developed, documented and utilized for the Rotochopper B-66T Horizontal Grinder while performing maintenance activities involving the removal of screens. An employee was removing/installing cylinder locks on the piston rod end of a hydraulic cylinder when the cylinder was energized and an employee's middle finger and thumb were crushed between a cylinder lock and a washer/locking nut. This condition exposed an employee to amputation and crushing hazards during maintenance activities.

29 CFR 1910.147(c)(7)(i): The employer did not provide adequate training to ensure that the purpose and function of the energy control program was understood by employees, and to ensure that employees acquired the knowledge and skills required for the safe application, usage and removal of energy control devices: (a)Mueller Pallets, L.L.C. at 801 Prairie Street, Harrisburg, SD 57032: On or about and at times prior to April 9, 2025, the employer did not provide adequate training to ensure that the purpose and function of the energy control program was understood by employees, and to ensure that employees acquired the knowledge and skills required for the safe application, usage and removal of energy control devices, including but not limited to the following machines or equipment: (1) Rotochopper B66T Horizontal Grinder Abatement Note: The training shall include the following: (1) Each authorized employee shall receive training in the recognition of applicable hazardous energy sources, the type and magnitude of the energy available in the workplace, and the methods and means necessary for energy isolation and control. (2) Each affected employee shall be instructed in the purpose and use of the energy control procedure. (3) All other employees whose work operations are or may be in an area where energy control procedures may be utilized, shall be instructed about the procedure, and about the prohibition relating to attempts to restart or reenergize machines or equipment which are locked out or tagged out.
