29 CFR 1910.95(d)(1): When information indicates that any employee's exposure may equal or exceed an 8-hour time-weighted average of 85 decibels, the employer shall develop and implement a monitoring program. On or about May 13, 2025, employees were exposed to high noise levels that were equivalent or exceeding the 8-hour time-weighted average (TWA) of 85 dBA and the employer did not ensure a noise monitoring program was implemented onsite for the following: a. On or about May 13, 2025, Viking Champion Automated Pallet Assembler 304A operator was exposed to noise to 99.7% of the permissible daily dose, or an average sound level of 89.8 dbA, as measured over 480 minutes of sampling. This dose is equivalent to an 8-hour TWA exposure of 90.0 dbA, accounting for period of 0 minutes unmonitored. No abatement certification or documentation required for this item.

29 CFR 1910.95(g)(5)(i): Within 6 months of an employee's first exposure at or above the action level, the employer shall establish a valid baseline audiogram against which subsequent audiograms can be compared. On or about May 13, 2025, the employer did not establish a valid baseline audiogram for a Viking Champion Automated Pallet Assembler 304A operator exposed to noise levels that were equivalent or exceeded an 8-hour time weighted average (TWA) of 85 dBA. Abatement documentation is required of this item in accordance with the requirements of 29 CFR 1903.13(c).

29 CFR 1910.95(k)(1): The employer shall train each employee who is exposed to noise at or above an 8-hour time weighted average of 85 decibels in accordance with the requirements of this section. The employer shall institute a training program and ensure employee participation in the program. On or about May 13, 2025, the employer did not ensure training was provided to a Viking Champion Automated Pallet Assembler 304A operator exposed to noise levels that were equivalent or exceeded an 8-hour time weighted average (TWA) of 85 dBA. The employer did not ensure training was provided on various elements of a hearing conservation program such as, but not limited to, the effects of noise on hearing, purpose of hearing protection (i.e. advantage, disadvantages, types, selection, fitting, use, and care), the purpose of audiometric testing and explanation of test procedures. Abatement documentation is required for this item in accordance with the requirements of 29 CFR 1903.19(d).
