29 CFR 1910.132(d)(1): Hazard assessment and equipment selection. The employer shall assess the workplace to determine if hazards are present, or are likely to be present, which necessitate the use of personal protective equipment (PPE). If such hazards are present, or likely to be present, the employer shall: (i) Select, and have each affected employee use, the types of PPE that will protect the affected employee from the hazards identified in the hazard assessment; a) On or about April 22, 2025 in EV705 SOLEpoxy DK15-0907 (powder coat) room and at the related dust collection units for the powder coat, the employer had not required the use of PPE identified to be, nitrile exam gloves or similar type of glove, and body covering when employees were cleaning the powder coat room and changing out the dust collection barrels of powder coat.

Employees shall be informed of: (i) The requirements of this section; (ii) Any operations in their work area where hazardous chemicals are present; and, (iii) The location and availability of the written hazard communication program, including the required list(s) of hazardous chemicals, and safety data sheets required by this section. a) On or about April 22, 2025 in EV705 SOLEpoxy DK15-0907 (powder coat), the employer did not ensure that employees were provided with training and information on hazardous chemicals in that they did not inform employees of operations where hazardous chemicals were located, how to obtain the written hazardous communication program, and how to obtain the safety data sheets for chemicals such as but not limited to SOLEpoxy DK15 0907 (sensitizer), lubricant, and windex.

29 CFR 1910.1200(h)(3): Employee information and training. Training. Employee training shall include at least: (ii) The physical, health, simple asphyxiation, combustible dust, and pyrophoric gas hazards, as well as hazards not otherwise classified, of the chemicals in the work area; (iii) The measures employees can take to protect themselves from these hazards, including specific procedures the employer has implemented to protect employees from exposure to hazardous chemicals, such as appropriate work practices, emergency procedures, and personal protective equipment to be used; and, a) On or about April 17, 2025, the employer had not provided training on SOLEpoxy DK15-0907 Powder Coat for the combustible dust hazards and for the health hazards such as skin sensitization, nor has the employer provided employees training with measures that can be taken to protect themselves such as work practices and personal protective equipment to be worn to protect themselves from these hazards. The Schneider Electric USA, Inc. AKA Schneider Electric was previously cited for a violation of this occupational safety and health standard or its equivalent standard, which was contained in OSHA inspection number 1509085, citation number 1, item number 6 and was affirmed as a final order on June 2, 2022, with respect to a workplace located at 5735 College Corner Pike, Oxford, OH 45056.

29 CFR 1910.134(k)(6):The basic advisory information on respirators, as presented in Appendix D of this section, shall be provided by the employer in any written or oral format, to employees who wear respirators when such use is not required by this section or by the employer. a) On or about April 22, 2025 in EV 705 Powder Coat Room and at the Powder Coat Dust Collection units, the employer did not ensure that employees who were provided with the N95 DuraMask 1895 N95 filtering facepieces for voluntary use were provided with the information contained in 1910.134 Appendix D prior to use.
