29 CFR  1903.19(d)(1): The employer did not submit to the Agency documents demonstrating that abatement is complete for each willful or repeat violation and for any serious violation for which the Agency indicates in the citation that such abatement documentation is required.  (a) J.C. Exteriors LLC failed to document abatement within 10 calendar days after the abatement date that each of the following cited violations had been corrected.  Citation 1, Item 1, a serious violation of 29 CFR 1926.503(c)(3) with an abatement date of June 4, 2025. Citation 2, Item 1, a repeat-serious violation of 29 CFR 1926.501(b)(13) with an abatement date of June 4, 2025. Citation 3, Item 1, an other-than-serious violation of 29 CFR 1926.503(b)(1) with an abatement date of June 4, 2025.  In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATIONS OF THE CORRECTIVE ACTION WORKSHEET).

29 CFR  1926.503(c)(3): When the employer has reason to believe that any affected employee who has already been trained does not  have the understanding and skill required by paragraph (a) of this section, the employer shall retrain each such employee.  (a) On or about April 16, 2025, the employer had not retrained and verified employees understood the proper methods of installing and utilizing fall protection equipment/systems. Exposing employees to a fall hazard of up to 9.5 feet to the ground below.

29 CFR  1926.1053(b)(1):Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed.  (a) On or about April 16, 2025, the employer did not ensure the extension ladder used to access and egress the two-story residential property extended at least three feet above the upper landing and was not secured to prevent displacement when used. Thereby, exposing employees to a fall hazard of approximately 9.5 feet to the ground below.  (b) On or about April 16, 2025, the employer did not ensure the extension ladder used to access and egress the detached residential garage extended at least three feet above the upper landing and was not secured to prevent displacement when used. Thereby, exposing employees to a fall hazard of approximately 8.5 feet to the ground below.

29 CFR  1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b).  (a)  On or about April 16, 2025, employees conducting tear off on an existing two-story residential roof with a 6:12 pitch were not protected from falling to the lower level. Exposing employees to a fall hazard of approximately 9.5 feet to the ground below.  (b) On or about April 16, 2025, employees conducting tear off on an existing one-story detached garage with a 4:12 pitch were not protected from falling to the lower level. Exposing employees to a fall hazard of approximately 8.5 feet to the ground below.  J.C. Exteriors LLC was previously cited for a violation of this occupational safety and health standard, which was contained in OSHA inspection number 1774324, citation number 1, item number 1 and was affirmed as a final order on October 25, 2024, with respect to a workplace located at 2601 Farmington Lane, Oak Creek, WI 53154.
