29 CFR  1903.19(c)(1): Within 10 calendar days after the abatement date, the employer must certify to OSHA (the Agency) that each cited violation has been abated, except as provided in paragraph (c)(2) of this section.  The employer failed to provide certification of abatement for the citations related to not determining the airborne concentrations of asbestos, providing employees with training on asbestos, and developing and implementing a written silica exposure control plan, that were issued on June 24, 2025.

29 CFR  1926.1101(f)(2)(i): Each employer who has a workplace or work operation covered by this standard shall ensure that a "competent person" conducts an exposure assessment immediately before or at the initiation of the operation to ascertain expected exposures during that operation or workplace. The assessment must be completed in time to comply with requirements which are triggered by exposure data or the lack of a "negative exposure assessment," and to provide information necessary to assure that all control systems planned are appropriate for that operation and will work properly.  a) On or about and at times prior to April 3, 2025, at the worksite located at 505 Knapp Street, Oshkosh, Wisconsin, the employer did not perform exposure monitoring to determine the airborne concentrations of asbestos to which employees may have been exposed to while removing bricks that were identified to have caulking, which contained approximately 2% chrysotile asbestos, exposing employees to the hazards associated with asbestos.

29 CFR  1926.1101(k)(9)(i):The employer shall train each employee who is likely to be exposed in excess of a PEL, and each employee who performs Class I through IV asbestos operations, in accordance with the requirements of this section. Such training shall be conducted at no cost to the employee. The employer shall institute a training program and ensure employee participation in the program.  a) On or about and at times prior to April 3, 2025, at the worksite located at 505 Knapp Street, Oshkosh, Wisconsin, the employer had not provided asbestos training to each employee who was removing bricks that were identified to have caulking, which contained approximately 2% chrysotile asbestos, exposing employees to the hazards associated with asbestos.

29 CFR  1926.501(b)(1): Each employee on a walking/working surface (horizontal and vertical surface) with an unprotected side or edge which is 6 feet (1.8 m) or more above a lower level shall be protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems.  a) On or about April 24, 2025, at the worksite located at 505 Knapp Street, Oshkosh, Wisconsin; the employer did not ensure that an employee performing demolition work on the second floor of a building working near the floor edge was protected from falls, exposing an employee to fall hazards. The height of the second floor was approximately 8 feet above a lower level.  Recyclean, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard, 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1502817, citation number 1, item number 1a, and was affirmed as a final order on May 14, 2021, with respect to a workplace located at 240 Raleigh Road, Kenilworth, IL 60043.

29 CFR  1926.1153(g)(1): The employer shall establish and implement a written exposure control plan that contains at least the following elements: (i) A description of the tasks in the workplace that involve exposure to respirable crystalline silica; (ii) A description of the engineering controls, work practices, and respiratory protection used to limit employee exposure to respirable crystalline silica for each task; (iii) A description of the housekeeping measures used to limit employee exposure to respirable crystalline silica; and (iv) A description of the procedures used to restrict access to work areas, when necessary, to minimize the number of employees exposed to respirable crystalline silica and their level of exposure, including exposures generated by other employers or sole proprietors.  a) On or about and at times prior to April 3, 205, at the worksite located at 505 Knapp Street, Oshkosh, Wisconsin; the employer did not establish and implement a written silica exposure control plan for when employees used an excavator to demolish a building containing brick and mortar, exposing employees to the hazards associated with respirable crystalline silica.
