29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet or more above lower levels was not protected by a guardrail system, safety net system, or personal fall arrest system, or an alternative fall protection measure that meets a provision described in paragraph (b) of this section: a) Jobsite located at or near 743-747 North Capitol Street, Philadelphia, PA - On or about April 21, 2025, the employer did not ensure employees engaged in residential construction activities 6 feet or more above lower levels were protected by guardrail systems, safety net system, or personal fall arrest system. Employees were performing framing activities on the forth story of a residential building approximately 40 feet above ground level without the use of a fall protection system. b) Jobsite located at or near 743-747 North Capitol Street, Philadelphia, PA - On or about April 21, 2025, the employer did not ensure employees engaged in residential construction activities 6 feet or more above lower levels were protected by guardrail systems, safety net system, or personal fall arrest system. An employee utilized a stairway that contained an unprotected side to access the interior of the second floor, and was thereby exposed to fall hazards of approximately 20 feet to the next ground level.

29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards: a) Jobsite located at or near 743-747 North Capitol Street, Philadelphia, PA - On or about April 21, 2025, the employer did not provide fall protection training to employees who were exposed to fall hazards. Employees were performing framing activities from heights greater than 6 feet without being trained on fall protection, thereby exposing employees to fall hazards.
