29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):  a) J.S. Aldo's Construction Co. Inc. does not ensure that employees use fall protection while engaged in roofing activities 6 feet (1.8 m) or more above lower levels.     This violation occurred  on 04/23/2025, at 618 Maywood Avenue, Maywood NJ. Employees that were engaged in the roofing activities were not protected from fall hazards of approximately 22 feet to the ground below. The employees were removing the existing roof and started to install new plywood, underlayment and shingles without using any form of fall protection. Two employees fell from the roof while installing underlayment on or about 4/23/2025.    Pursuant to 29 CFR 1903.29, within 30 days the employer must submit documents describing the steps it is taking to ensure compliance, including a description of how these steps protect its employees from fall hazards.

Employees that were engaged in the roofing activities were not protected from fall hazards of approximately 22 feet to the ground below. Employees wearing harnesses and tool belts were observed walking across the roof, one of whom was carrying a bucket of anchors, but none of the employees were tied off to a safety line.     Pursuant to 29 CFR 1903.29, within 30 days the employer must submit documents describing the steps it is taking to ensure compliance, including a description of how these steps protect its employees from fall hazards.ds.
