29 CFR 1910.28(b)(3)(ii): The employer did not ensure each employee is protected from tripping into or stepping into or through any hole that is less than 4 feet (1.2 m) above a lower level by covers or guardrail systems: a) On April 19, 2025, and at times prior, in the Lime Kiln Building, at American Crystal Sugar located at 121 Highway 81 Northeast in Hillsboro, North Dakota, employees were exposed to slip, trip, and fall hazards as well as thermal and chemical burns hazards while preparing to remove the sump pump where a 10" by 10" sump pit opening was not guarded and the floor was flooded by Milk of Lime.

29 CFR 1904.39(a)(2): The employer did not report an in-patient hospitalization, amputation, or loss of an eye as a result of a work-related incident to OSHA within twenty-four hours: a) On April 19, 2025, at the American Crystal Sugar Facility located at 121 Highway 81 NE in Hillsboro, North Dakota, an employee injury occurred as the result of thermal and chemical burns resulting in the employee being hospitalized, which was not reported to OSHA until April 24, 2025 Note: This company was previously cited for a violation of this occupational safety and health standard or its equivalent standard, which was contained in OSHA Inspection No. 1789885, Citation 1, Item 1 and was affirmed as a final order on March 14, 2025.
