29 CFR 1910.28(b)(11)(ii): The employer did not ensure that each flight of stairs having at least 3 treads and at least 4 risers is equipped with stair rail systems and handrails as described in 29 CFR 1910.28 Table D-2-Stairway Handrail Requirements.  At a worksite located at 6439 State Highway 43, Joplin, MO, employees were exposed to fall hazards.  The employer exposed the employees to these hazards by allowing them to utilize a flight of stairs from the main level to the second level of building 2 without a handrail available for employees to grasp.

29 CFR  1910.146(c)(4):When the employer decided that its employees would enter permit spaces, the employer did not develop and implement a written permit space entry program that complied with 29 CFR 1910.146:  At a worksite located at 6439 State Highway 43, Joplin, MO, employees were exposed to atmospheric hazards that may include asphyxiation and explosive hazards.  The employer exposed the employees to these hazards by allowing them to enter inside permit required confined spaces without first establishing and implementing a written permit space entry program that included all required program elements.  Instances of exposure include, but are not limited to:  1.  Employees enter inside tanks in building 2 while performing welding and grinding operations, typically in bay 1 of the building.  Required steps for entry into permit required confined spaces are not taken prior to entry and include such items as initial air quality monitoring prior to entering the tank, alternate procedures performed prior to entering tanks and maintaining written documentation related to entry into the tanks..  2.  Employees enter inside tanks near building 1 while performing sand blasting operations.  Required steps for entry into permit required confined spaces are not taken prior to entry and include such items as initial air quality monitoring prior to employees entering the tanks, and completing and maintaining permits associated with entry into the tanks.

29 CFR  1910.179(j)(1)(ii)(a):The employer did not ensure frequent inspections in daily to monthly intervals were conducted.  At a worksite located at 6439 State Highway 43, Joplin, MO, employees were exposed to struck by hazards.  The employer exposed the employees to these hazards by allowing them to utilize overhead cranes in buildings 1 and 2 that did not have documented frequent inspections to ensure that the cranes remained in good working order.

The employer exposed the employees to these hazards by allowing them to utilize a hydraulic press brake without first ensuring that they were protected from hazards created by the point of operation.
