29 CFR  1926.652(a)(1):Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652 (b) or (c):  (a)  Jobsite:  On or about April 5, 2025, two employees were working in a trench that measured from 9 feet 8 inches to 11 feet in depth and both employees were outside of the trench box that was in the trench.  The trench sidewalls were almost vertical.  (b):  Jobsite:  On or about April 5, 2025, two employees were at times working inside a trench box and the almost vertical sidewalls of the trench extended about 4 feet above the top of the trench  box.

29 CFR  1926.651(k)(2): Where the competent person found evidence of a situation that could result in possible cave-in, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions, exposed employee(s) was/were not removed from the hazardous area until the necessary precautions have been taken to ensure their safety:  (a)  Jobsite:  On or about April 5, 2025, the competent person did not remove two employees from working in an unshored 9 feet 8 inch to 11 feet deep trench with almost vertical sidewalls.

29 CFR  1926.100(a):  Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets:  (a)  Jobsite:  On or about May 5, 2025, two employees were working in an approximately 9 foot 8 inch to 11 foot deep trench and they were not wearing any head protection.  The sidewalls were approximately 85 degrees.
