29 CFR  1910.178(l)(1)(i): The employer did not ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l):   (a) Worksite -  On or about April 15, 2025, an employee was authorized to use a JLG 10054 Sky Track telehandler with a wood box attached to the forks to collect roofing debris and was not trained and certified to operate the powered industrial truck.    (b) Worksite - On or about April 17, 2025, an employee was authorized to use a JLG 10054 Sky Track telehandler with a wood box attached to the forks to collect roofing debris and was not  trained and certified to operate the powered industrial truck.

29 CFR  1926.502(b)(2): Midrails, screens, mesh, intermediate vertical members, or equivalent intermediate structure members were not installed between the top edge of the guardrail system and the walking/working surface when there was no wall or parapet wall at least 21 inches (53 cm) high:  (a) Worksite - On or about April 15, 2025, employees were working along the edge of the roof of a school building approximately  14-feet above the lower level roof with a parapet wall between 11 inches to 27 inches tall. The employer did not ensure midrails were installed along the areas where the parapet walls were below 21 inches.

29 CFR  1926.502(b)(3): Guardrail systems were not capable of withstanding, without failure, a force of at least 200 pounds (890 N) applied within 2 inches (5.1 cm) of the top edge, in any outward or downward direction, at any point along the top edge:   (a) Worksite, roof: On or about April 17, 2025, employees were working along the edge of a flat roof of a school building approximately 40-feet above the ground. The  guardrail system was constructed from pieces of wood and was not capable of withstanding at least 200 pounds of force exposing employee to fall hazards.

29 CFR  1926.503(b)(1): The employer did not verify compliance with paragraph (a) of this section by preparing a written (training) certification record including the name or other identity of the employee trained, the date(s) of the training, and the signature of the person who conducted the training or the signature of the employer:    (a) Worksite - On or about April 15, 2025, employees were working on a flat roof of a school building and exposed to fall hazards between approximately 14 - 40-feet. The employer did not verify employees fall protection training with a written certification.
