29 CFR 1910.178(q)(7): Powered industrial trucks. Operation of the truck. Industrial trucks shall be examined before being placed in service, and shall not be placed in service if the examination shows any condition adversely affecting the safety of the vehicle. Such examination shall be made at least daily. Where industrial trucks are used on a round-the-clock basis, they shall be examined after each shift. Defects when found shall be immediately reported and corrected. a) On or about May 8, 2025, employer did not ensure that daily inspections conducted were adequate prior to utilizing the GEHL Dynalift (DL12-40 model 820351) and Mitsubishi Forklift (model FG20K) on a daily basis, in that the GEHL Dynalift (DL12-40 model 820351) had split tires, and that the Mitsubishi Forklift (model FG20K) had split tires, broken lights, and a broken seat.

The user shall see that all nameplates and markings are in place and are maintained in a legible condition. a) On or about May 08, 2025, the employer did not ensure that the Mitsubishi Forklift (model FG20K) had a data plate maintained in a legible condition, in that the data on the plate had worn off and could not be read.

29 CFR 1910.254(d)(9)(iii): Cables with damaged insulation or exposed bare conductors shall be replaced. Joining lengths of work and electrode cables shall be done by the use of connecting means specifically intended for the purpose. The connecting means shall have insulation adequate for the service conditions. [55 FR 13709, Apr. 11, 1990; 61 FR 9227, March 7, 1996; 70 FR 53929, Sept. 13, 2005] a) On or about May 08, 2025, in the Welding Shop, the employer did not ensure that ground connections on the Power MIG welder were electrically adequate, in that the ground cable lead had missing insulation, exposing employees to electrical shock hazards.
