29 CFR 1926.503(a)(1):The employer shall provide a training program for each employee who might be exposed to fall hazards. The program shall enable each employee to recognize the hazards of falling and shall train each employee in the procedures to be followed in order to minimize these hazards. On or about May 12, 2025, at a worksite located at 4286 Bellhaven Lane, Oshkosh, WI, the employer did not ensure that employees exposed to fall hazards of 9 feet while conducting re-roofing of a residential house had received training in the recognition of fall hazards and methods to mitigate those hazards prior to exposure.

The program shall enable each employee to recognize hazards related to ladders and stairways, and shall train each employee in the procedures to be followed to minimize these hazards. On or about May 12, 2025, at a worksite located at 4286 Bellhaven Lane, Oshkosh, WI, the employer did not ensure that employees using the lower section of a 24' Werner Fiberglass Extension ladder were trained in the recognition, and mitigation, of ladder hazards prior to using the ladder to access the roof of a residential structure, exposing them to falls of 9 feet.

29 CFR 1926.1053(b)(1): When portable ladders are used for access to an upper landing surface, the ladder side rails shall extend at least 3 feet (.9 m) above the upper landing surface to which the ladder is used to gain access; or, when such an extension is not possible because of the ladder's length, then the ladder shall be secured at its top to a rigid support that will not deflect, and a grasping device, such as a grabrail, shall be provided to assist employees in mounting and dismounting the ladder. In no case shall the extension be such that ladder deflection under a load would, by itself, cause the ladder to slip off its support. On or about May 12, 2025, at a worksite located at 4286 Bellhaven Lane, Oshkosh, WI, employees were exposed to fall hazard of 9 feet while using the lower section of a 24' Werner Fiberglass Extension Ladder to access and egress an upper landing surface when the mobile ladder was not extended 3 feet above the landing surface nor was it secured and a grasping device provided.
