1910.23(b)(8) (8) Ladders are used only for the purposes for which they were designed; a) On or about May 11, 2025, a task was undertaken whereby a worker could not reasonably maintain three points of contact on the ladder when performing the work and did not wear fall protection on accordance with plant policy. Abatement certification and documentation required within 10 days after abatement date. The certification shall include a statement that abatement is complete, the date and method of abatement, and state that employees and their representatives were informed of this abatement. Abatement documentation shall include documents demonstrating that abatement is complete, such as evidence of the purchase or repair of equipment, photograph or video evidence of abatement or other written records.

29 CFR 1910.147(f)(1)(v): All systems were not de-energized and energy control measures reapplied in accordance with paragraph (d) of this section to continue the servicing and/or maintenance: a) Caustic Department, 15696 Energy Road, Proctor, WV 26055: On or about May 11, 2025, employees performed servicing such as tightening bolts on the upper manway cover of the 1A surface condenser that was under an internal pressure of approximately 58 psi, exposing employees to a potential struck by hazard. The condenser was not depressurized and energy control measures were not reapplied before employees began tightening bolts on the upper manway cover. Abatement certification and documentation required within 10 days after abatement date. The certification shall include a statement that abatement is complete, the date and method of abatement, and state that employees and their representatives were informed of this abatement. Abatement documentation shall include documents demonstrating that abatement is complete, such as evidence of the purchase or repair of equipment, photograph or video evidence of abatement or other written records.

The employer did not ensure the outside employer was informed of the lockout procedures and hazards of performing tasks under pressurized vessels exposing employees to potentially harmful energy. Abatement certification and documentation required within 10 days after abatement date. The certification shall include a statement that abatement is complete, the date and method of abatement, and state that employees and their representatives were informed of this abatement. Abatement documentation shall include documents demonstrating that abatement is complete, such as evidence of the purchase or repair of equipment, photograph or video evidence of abatement or other written records.
