29 CFR 1926.651(k)(2): Where the competent person finds evidence of a situation that could result in a possible cave-in, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions, exposed employees shall be removed from the hazardous area until the necessary precautions have been taken to ensure their safety. On or about May 16, 2025, the competent person failed to remove an exposed employee from a 7.5 foot deep trench, exposing employees to the hazards associated with a cave-in. Abatement documentation is required of this item in accordance with the requirements of 29 CFR 1903.19(d).

29 CFR 1926.652(a)(1): Each employee in an excavation shall be protected from cave-ins by an adequate protective system designed in accordance with paragraph (b) or (c) of this section: On or about May 16, 2025, employees were not protected from cave-ins while working inside a trench at a depth of 7.5 feet, exposing employees to the hazards associated with a cave-in. Abatement documentation is required of this item in accordance with the requirements of 29 CFR 1903.19(d).
