29 CFR 1910.119(d)(3)(i)(B): The employer did not include all equipment that was part of the process on piping and instrument diagrams(a): (b)Red River Energy, LLC, at 47333 104th Street, Rosholt, SD 57260: On or about and at times prior to May 5, 2025, the employer did not identify the pipeline eductor connected to V-503 was identified in the piping and instrument diagram for the Regeneration System (0500-Z02). This condition can increase the risk of human performance errors during operations which can expose employees to fire and explosion hazards. (c)Red River Energy, LLC, at 47333 104th Street, Rosholt, SD 57260: On or about and at times prior to May 5, 2025, the employer did not include the half-inch valve between Pump P-501B and FCV-0598 in the piping and instrument diagram for the Rectifier and Side Stripper (0400-Z02). The half-inch valve was labeled as 0547, however this label was not included in the associated piping and instrument diagram. This condition can increase the risk of human performance errors during operations which can expose employees to fire and explosion hazards.

29 CFR 1910.119(f)(1): The employer did not develop and implement written operating procedures that provided clear instructions for safely conducting activities involved in each covered process consistent with the process safety information: (a)Red River Energy, LLC, at 47333 104th Street, Rosholt, SD 57260: On or about and at times prior to May 3, 2025, the employer did not develop and implement written operating procedures that provided clear instructions for safely conducting normal shutdown of the molecular sieve within the Mole Sieve-500 Start Up and Shut Down operating procedure, in that preclusions of or clear instructions on how to safety perform pumping contents out of the Regen Tank (T-503) prior to completing shutdown of the molecular sieves was not included in the Mole Sieve-500 Start Up and Shut Down operating procedure. In this case the contents of the Regen Tank (T-503) were pumped out activating the T-503 low level alarm interlock that shut down pump 503-A. These event created a pressure imbalance between the molecular sieves and the Regen Tank (T-503) causing cavitation of the Regen Tank (T-503) that could have resulted in a release. This condition exposed employees to fire, explosion and struck-by hazards.

29 CFR 1910.119(f)(4): The employer did not develop and implement safe work practices to provide for the control of hazards during operations such as lockout/tagout; confined space entry; opening process equipment or piping; and control over entrance into a facility by maintenance, contractor, laboratory, or other support personnel: (a)Red River Energy, LLC, at 47333 104th Street, Rosholt, SD 57260: On or about and at times prior to May 5, 2025, the employer did not develop and implement safe work practices to prepare adjacent vessels, piping and equipment for non-routine work including, but not limited to, confined space entry and hot work. On May 5, 2025, confined space entry and hot work were performed within the Regen Tank (T-503), during this work, ethanol leaking from an open low point drain from 190 Tank (T-501) was ignited and cause rupture of the 190 Tank (T-501). The employer had not developed and implemented safe work practices including but not limited to measures to rinse, isolate and/or otherwise prepare adjacent vessels, piping and equipment to support confined space entry and hot work. This condition exposed employees to fire and explosion hazards.

29 CFR 1910.119(j)(2):The employer did not establish written procedures to maintain the on-going integrity of process equipment: (a)Red River Energy, LLC, at 47333 104th Street, Rosholt, SD 57260: On or about and at times prior to May 5, 2025, the employer had not established written procedures to maintain the on-going integrity of valve XV-501. Valve XV-501's seal failed allowing 190 proof ethanol to pass back into the 190 proof tank (T-501) from the shift tank (T-1002). 190 proof ethanol then drained out of the 190 proof tank (T-501) from a low point drain and collected in nearby sump pit. On May 5, 2025, hot work performed on the regen tank (T-503) ignited flammable liquid that had collected in or within the vicinity of the sump pit and traveled back into the 190 proof tank causing the tank to rupture after internal ignition. The employer had not established any written procedures to maintain the ongoing integrity of valve XV-501 prior to this incident. This condition exposed employees to fire and explosion hazards.
