29 CFR 1910.28(b)(1)(i):Except as provided elsewhere in this section 29 CFR 1910.28, the employer did not ensure that each employee on a walking-working surface with an unprotected side or edge that is 4 feet (1.2 m) or more above a lower level is protected from falling by one or more of the systems described in 29 CFR 1910.28(b)(1)(i): On or about May 24, 2025, the employer did not ensure that employees tasked with standing on equipment tied to the incline conveyor system of the Mozzarella "cuber" line during cleaning activities were protected from falling more than 4 feet. Employees were tasked with climbing or scaling the apparatus to reach the upper area of the conveyor and equipment. The employees dismantle the upper portion of the inclined conveyor while standing on the lower portion of the apparatus with a height of 4 feet 10 inches.

The "cuber" shredded mozzarella line has not received a periodic inspection of the procedures within the last 12 months as required by the standard. Hazardous energies present on equipment includes but is not limited to mechanical and electrical. A periodic inspection had not been conducted since June of 2023. Miceli Dairy Products Co. was previously cited for a violation of this occupational safety and health standard 29 CFR 1910.147(c)(7)(i)(A) , which was contained in OSHA inspection number 1661150, citation number 1, item number 3, and was affirmed as a final order on 05/24/2023, with respect to a workplace located at 2721 East 90th Street, Cleveland, OH 44104.
