29 CFR 1926.651(c)(2):Means of egress from trench excavations. A stairway, ladder, ramp or other safe means of egress shall be located in trench excavations that are 4 feet (1.22 m) or more in depth so as to require no more than 25 feet (7.62 m) of lateral travel for employees. On or about June 4, 2025, during the installation of a sanitary sewer line at a worksite located at Wampler Park, 1818 Main Avenue W., Massillon, Ohio, the employer failed to ensure employees working inside a trench, with a varying depth of approximately 4.5 to 4.9 feet and a length of approximately 35 feet, were provided with a safe means of egress from the trench such as a stairway, ladder, and/or ramp within not more than 25 feet of lateral travel from the employees.

29 CFR 1926.651(j)(2):Employees shall be protected from excavated or other materials or equipment that could pose a hazard by falling or rolling into excavations. Protection shall be provided by placing and keeping such materials or equipment at least 2 feet (.61 m) from the edge of excavations, or by the use of retaining devices that are sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary. On or about June 4, 2025, during the installation of a sanitary sewer line at a worksite located at Wampler Park, 1818 Main Avenue W., Massillon, Ohio, the employer failed to ensure employees working inside a trench were protected from excavated material, consisting of dirt, that could pose a hazard by falling or rolling into the trench by keeping the material at least 2 feet from the edge of the trench or by the use of a retaining device. The excavated material (dirt) was placed within 1 foot or less of the edge of the trench.
