OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were not protected from the hazard of high heat while performing job duties.  Job site at 180 Maple St, East Longmeadow, MA:  On 06/05/2025, an employee was working for approximately six hours in direct sunlight and excessive heat performing moderate physical labor for extended periods, including spreading of adhesive on the roof while on hand and knees, and carrying and applying membrane sheets to the roof.  An employee exhibited symptoms consistent with heat illness including signs of confusion and fatigue, collapsed, and was unresponsive. The worker received emergency care from paramedics prior and during his transport to the hospital, where he died within the hour on the same day.    Wet Bulb Globe Temperature (WBGT) values were calculated for this location using data from the National Oceanic and Atmospheric Administration (NOAA) for June 5, 2025.  WBGT levels were elevated throughout the day and in the afternoon reached 92 degrees Fahrenheit.   The performance of moderate metabolic work activity with these exposures is likely to lead to the development of serious heat-related illnesses such as, but not limited to, heat cramps, heat stress, heat exhaustion, and heat stroke.  An employee was exposed to the heat-related hazards and sustained a heat-related illness resulting in death.
