29 CFR  1910.178(l)(1)(i): The employer did not ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l) and as referenced by the note contained in 1926.602(d)  :   a)  At  205 Mount Pleasant Boulevard, Lot 53 North Hills, Fairhope, Alabama:  On June 9, 2025; the employer allowed his employees to perform framing activities without fall protection exposing his employees to a fall hazard of up to 18 feet 1 inch to the ground below.

29 CFR  1926.304(d): Portable, power-driven circular saw(s) were not equipped with a guard above and below the base plate or shoe:  a)  At  205 Mount Pleasant Boulevard, Lot 53 North Hills, Fairhope, Alabama:  On June 9, 2025; the employer allowed his employees to operate a skill saw on site with the guard wedged up leaving the blade exposed and exposing his employees to struck-by hazards.

29 CFR  1926.451(c)(2)(iv): Front-end loaders and similar pieces of equipment were used to support scaffold platforms when they were not specifically designed by the manufacturer for such use:  a)  At  205 Mount Pleasant Boulevard, Lot 53 North Hills, Fairhope, Alabama:   On or about June 9, 2025, and at times prior to, the employer permitted employees to work from a job-made work platform that was being elevated by a JCB Telehandler Model # 509-42, which was not approved for that use by the manufacturer, exposing employees to fall hazards of up to 18 feet to the ground below.

The Jose Luis Pecina dba Jose Luis Pecina was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(B)(13), which was contained in OSHA inspection number 1790790, citation number 1, item number 3 and was affirmed as a final order on January 30, 2025, with respect to a workplace located at 193 Mount Pleasant Boulevard, Lot 50 North Hills, Fairhope, Alabama.
