29 CFR  1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:  a)  At 3162 Serviceberry Road, Lot 11F Reserve at Brookhaven, Cantonment, Florida:  On June 10, 2025; the employer allowed his employees to use an extension ladder to gain access to the second level of the house and the rails of the ladder did not extend three feet above the landing area to provide safe access exposing his employees to a fall hazard of 10 feet 10 inches to the ground below.

29 CFR  1926.102(a)(1): The employer did not ensure that each affected employee used appropriate eye or face protection when exposed to eye or face hazards from flying particles:  a)  At 3162 Serviceberry Road, Lot 11F Reserve at Brookhaven, Cantonment, Florida:  On June 10, 2025; the employer allowed his employees to operate pneumatic nail guns without eye protection while performing framing activities exposing his employees to struck-by hazards.  The Jose Antonio Padilla dba Jose Antonio Padilla was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.102 (A)(1), which was contained in OSHA inspection number 1797907, citation number 1, item number 1 and was affirmed as a final order on January 24, 2025, with respect to a workplace located at 2921 Winterberry Road, Lot 13A Reserve at Brookhaven, Cantonment, Florida.

29 CFR  1926.501(b)(13):Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):   a)  At 3162 Serviceberry Road, Lot 11F Reserve at Brookhaven, Cantonment, Florida:  On June 10, 2025; the employer allowed his employees to perform framing activities without fall proteciton exposing his employees to a fall hazard of 10 feet 10 inches to the ground below.  The Jose Antonio Padilla dba Jose Antonio Padilla was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(B)(13), which was contained in OSHA inspection number 1797907, citation number 2, item number 1 and was affirmed as a final order on January 24, 2025, with respect to a workplace located at 2921 Winterberry Road, Lot 13A Reserve at Brookhaven, Cantonment, Florida and in OSHA inspection number 1777364, citation number 1, item number 1 and was affirmed as a final order on October 28, 2024, with respect to a workplace located at 3302 Grouse Road, Lot 71 Lakes of Woodbine, Milton, Florida.
