29 CFR 1926.1153(d)(2)(i): The employer shall assess the exposure of each employee who is or may reasonably be expected to be exposed to respirable crystalline silica at or above the action level in accordance with either the performance option in paragraph (d)(2)(ii) or the scheduled monitoring option in paragraph (d)(2)(iii) of this section. a) On or about June 30, 2025, at the worksite located at 179 N Adams Avenue, Berlin, Wisconsin; the employer did not assess the exposure of employees who are or may reasonably be expected to be exposed to respirable crystalline silica at or above the action level when employees were cutting brick and mortar containing crystalline silica with a reciprocating saw (ALLSAW AS200X), exposing employees to the hazards associated with respirable crystalline silica. Three bulk samples of cutting debris taken contained up to 20% crystalline silica.

29 CFR 1926.62(d)(1)(i): Each employer who has a workplace or operation covered by this standard shall initially determine if any employee may be exposed to lead at or above the action level. a) On or about June 30, 2025, at the worksite located at 179 N Adams Avenue, Berlin, Wisconsin; the employer did not perform an initial determination to assess if employees were exposed to inorganic lead at or above the action level while the employee was performing tasks, such as but not limited to cutting brick and mortar that was coated in lead-based paint, exposing employees to the hazards associated with inorganic lead. Two bulk samples of cutting debris taken contained up to 0.0545% inorganic lead.
