29 CFR 1926.1053(b)(1): Portable ladders were used for access to an upper landing surface and the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladder was used to gain access, or were not secured: (a) On or about July 1, 2025, at a jobsite located at 3122 Wood Rd, Mount Pleasant, WI 53406, the portable extension ladders being used to access the upper landing area or roof of the main structure did not extend at least three feet above the upper landing area and were not secured. This exposed employees accessing and egressing the roof, to a fall hazard of approximately 8-feet 8-inches onto grass, building materials, and concrete.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b): (a) On or about July 1, 2025, at a jobsite located at 3122 Wood Rd, Mount Pleasant, WI 53406, employees conducting roofing activities to include paper and shingle installation on an 6:12 pitch roof of the structure were not protected from falling to the lower level. This exposed employees to a fall hazard of approximately 8-feet 8-inches onto concrete, grass, and building materials. (b) On or about July 1, 2025, at a jobsite located at 3122 Wood Rd, Mount Pleasant, WI 53406, employees conducting roofing activities on a detached garage, to include tear-off on an 6:12 pitch roof of the structure were not protected from falling to the lower level. This exposed employees to a fall hazard of approximately 8-feet 8-inches at the eave up to 14 feet, 2 inches at the gabled ridge onto asphalt, grass, and building materials. Gallegos Construction Company was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(13) , which was contained in OSHA inspection number 1614410, citation number1, item number1, and was affirmed as a final order on February 1, 2023, with respect to a workplace located at 205 54TH St. Kenosha WI. 53140.
