29 CFR  1910.178(l)(1)(i): The employer did not ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l) and as referenced by the note contained in 1926.602(d)  :   a)  At  2701 Scenic Highway 98, Lot 9 Breakaway / Henderson Townhomes, Destin, Florida:  On July 1, 2025; the employer allowed his employees to operate a telehandler on site without first ensuring his employee was trained and certified to operate the Telehandler exposing his employees to struck-by hazards.

29 CFR  1926.451(c)(2)(iv): Front-end loaders and similar pieces of equipment were used to support scaffold platforms when they were not specifically designed by the manufacturer for such use:  a)  At  2701 Scenic Highway 98, Lot 9 Breakaway / Henderson Townhomes, Destin, Florida:   On or about July 1, 2025, and at times prior to, the employer permitted employees to stand on a sheet of plywood that was being elevated by a JCB T4 Telehandler to get employees on and off the upper levels of the house, which was not approved for that use by the manufacturer, exposing employees to fall hazards of up to 23 feet to the ground below.

29 CFR  1926.501(b)(13):Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):   a)  At  2701 Scenic Highway 98, Lot 9 Breakaway / Henderson Townhomes, Destin, Florida:  On June 9, 2025; the employer allowed his employees to perform framing activities without fall protection exposing his employees to a fall hazard of up to 35 to the ground below.  The Vulcano Carpentry, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(B)(10), which was contained in OSHA inspection number 1780855, citation number 1, item number 2, group A and was affirmed as a final order on November 21, 2024, with respect to a workplace located at 2640 W Michigan Highway, Tibbets Lumber, Pensacola, Florida.
