29 CFR  1910.134(c)(2)(ii): The employer must establish and implement those elements of a written respiratory protection program necessary to ensure that any employee using a respirator voluntarily is medically able to use that respirator, and that the respirator is cleaned, stored, and maintained so that its use does not present a health hazard to the user. Exception: Employers are not required to include in a written respiratory protection program those employees whose only use of respirators involves the voluntary use of filtering facepieces (dust masks).  On or about April 1, 2025, at the establishment located at 1228 West South Park Avenue, Oshkosh, Wisconsin; the employer did not establish and implement a written respiratory protection program for an employee that  voluntarily used a tight-fitting, elastomeric, half-mask respirator when sanding the ceiling in the shipping loading dock area. 29 CFR 1910.134(k): This paragraph requires the employer to provide effective training to employees who are required to use respirators. The training must be comprehensive, understandable, and recur annually, and more often if necessary:  On or about April 1, 2025, at the establishment located at 1228 West South Park Avenue, Oshkosh, Wisconsin; the employer did not provide training, such as but not limited to information on cleaning, maintenance, and storage components, and information on respirators in Appendix D of this section, to each employee that voluntarily wore a half-mask tight-fitting elastomeric respirator when sanding the ceiling in the shipping loading dock area.   All provisions of 29 CFR 1910.134(k)(1) through (k)(6) shall be provided to employees wearing respirators. Key elements include, but are not limited to the following:  1) Reason for respirators use 2) Respirator limitations and capabilities 3) Effective respirator inspection and use 4) Procedures for maintenance, care and storage of respirators 5) Recognition of signs/symptoms that may limit respirator use

29 CFR  1910.133(a)(1):  The employer shall ensure that each affected employee uses appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation:  On or about April 1, 2025, at the establishment located at 1228 West South Park Avenue, Oshkosh, Wisconsin; the employer did not ensure that Barrel Line employees used appropriate eye and face protection when exposed to chemical solutions on a zinc plating line.  A Barrel Line employee did not use splash proof goggles and face shield when working with corrosive chemicals  .

29 CFR  1910.1200(f)(6)(ii): Except as provided in paragraphs (f)(7) and (f)(8) of 29 CFR 1910.1200, the employer shall ensure that each container of hazardous chemicals in the workplace is labeled, tagged or marked with product identifier and words, pictures, symbols, or combination thereof, which provide at least general information regarding the hazards of the chemicals, and which, in conjunction with the other information immediately available to employees under the hazard communication program, will provide employees with the specific information regarding the physical and health hazards of the hazardous chemical.  On or about and at times prior to July 1, 2025, at the establishment located at 1228 West South Park Avenue, Oshkosh, Wisconsin; the employer did not ensure that each container of hazardous chemicals was labeled, tagged or marked with product identifier and words, pictures, symbols, or combination thereof, which provide at least general information regarding the hazards of the chemicals, exposing employees to the hazards associated with hazardous chemicals in the following instances:   a) In the staging area, the employer did not ensure that a plastic spray bottle with a red top containing WD-40 was appropriately labeled, tagged or marked with the product identifier and words, pictures, symbols, or combination thereof. The container had no labeling.   b) In the staging area, the employer did not ensure that two plastic spray bottles with blue tops containing oil was appropriately labeled, tagged or marked with the product identifier and words, pictures, symbols, or combination thereof. The container had a label with the product name, but it did not contain the other required information.  c) In the staging area, the employer did not ensure that a plastic squeeze bottle containing oil was appropriately labeled, tagged or marked with the product identifier and words, pictures, symbols, or combination thereof. The container had a label with the product name, but it did not contain the other required information.
