Section 5(a)(1) of the Occupational Safety and Health Act  of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were not protected from the hazard of high heat while performing job duties.  Fresh Point:  105 Reserve Rd, Hartford, CT 06114  On or around June 24, 2025, and at times thereafter, employees were exposed to the hazard of high heat from direct sun during the performance of their job duties, including working outside to remove and install dock levelers during an 8-hour shift. An employee was exposed to high heat and developed signs and symptoms of heat-related illness. The outdoor temperature at the time of the incident was 99 degrees Fahrenheit according to the National Weather Service. An excessive heat warning was in effect that day for the Hartford, CT area with a heat index in the Danger Risk level, as indicated by the NIOSH Heat App. Such exposures are likely to lead to the development of serious heat-related illnesses such as, but not limited to, heat cramps, heat stress, heat exhaustion, heat stroke and death. An employee was exposed to heat-related hazards and sustained a heat-related illness resulting in hospitalization for a heat-induced seizure that lead to loss of consciousness from the heat.

29 CFR  1904.39(a)(2): The employer did not report within 24-hours a work-related incident resulting in in- patient hospitalization, amputation, or the loss of an eye:   (a)        Date of Violation: On or about 06/24/25               Condition: An employee was hospitalized after experiencing symptoms associated with heat stroke, including loss of consciousness and seizures. This incident occurred while the employee was working outdoors in high temperatures, performing strenuous work to remove a dock leveler. As a result, the employee was hospitalized overnight for treatment of corresponding symptoms. The employer discovered the event on June 24, 2025, but did not contact OSHA  until June 30, 2025, to report the inpatient hospitalization.
