29 CFR 1926.451(g)(1)(vii): Each employee on a scaffold, not otherwise specified in paragraphs (g)(1)(i) through (g)(1)(vi) of this section, more than 10 feet (3.1 m) above lower level was not protected from falls by the use of personal fall arrest systems or guardrail systems meeting the requirements of paragraph (g)(4) of this section.  a) New residential construction located on Lot 19 Beechnut Road, Cumming, GA 30041, Roof: On or about 07/22/2025, the employer exposed employees to falls of over 13-feet while working on a make shift scaffold system,  in that a fall protection system was not provided while engaged in siding activities.

29 CFR  1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m)  or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501(b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502:  a) New residential construction located on Lot 19 Beechnut Road, Cumming, GA 30041, Roof: On or about 07/22/2025, the employer exposed employees to fall hazards to the lower level, in that a fall protection system was not provided to employees engaged in siding activities using the roof as a walking/working surface.

29 CFR 1926.403(b)(1): Employer did not ensure that electrical equipment is free from recognized hazards that are likely to cause death or serious physical harm to employees:  a) New residential construction located at Lot 19 Beechnut Road, Cumming, GA 30041: On or about 07/22/2025, the employer failed to inspect all electrical extension cords used to provide power to electric tools, in that an yellow 25-ft. electrical cord was damaged and exposing the internal insulated energized wires. An inspection of these cords was not performed prior to the shift as these cords were not repaired or removed from service.
