29 CFR 1926.651(h)(1):Employees were working in excavations in which there was accumulated water, or excavations in which water was accumulating, and adequate precautions had not been taken to protect employees against the hazards posed by water accumulation. On or about July 22nd, 2025, employees engaged in trenching operations located at East of 69th and Wren Court, Omaha, Nebraska 68117, were exposed to cave-in hazards in that the employer failed to adequate precautions were taken when water was present and accumulating in trench that collapsed and temporarily buried an employee.

29 CFR 1926.651(i)(3):Sidewalks, pavements, or appurtenant structures had been undermined and a support system or another method was not provided to protect employees from the possible collapse of such structures: On or about July 22nd, 2025, employees engaged in trenching operations located at East of 69th Wren Court, Omaha, Nebraska 68117, were exposed to cave-in hazards in that the employer failed to install a support system that was undermined under pavement. As a result, a partial collapse occurred that resulted in an employee being buried.

29 CFR 1926.651(k)(2): Where there was evidence of a situation that could result in a possible cave-in or other hazardous condition the competent person did not remove exposed employees until necessary precautions could be taken to ensure their safety. On or about July 22nd, 2025, employees engaged in trenching operations located at East of 69th and Wren Court, Omaha, Nebraska 68117, were exposed to cave-in hazards in that employee were working inside a trench that contained water accumulation, no protective systems installed on West side of the trench that reached depths of at least 7 feet 4 inches, and the trench undermined existing pavement.

29 CFR 1926.652(a)(1):Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652 (b) or (c). The employer is failing to protect employees from cave-in hazards. This was most recently documented on or about July 22nd, 2025, at East of 69th Wren Court, Omaha, Nebraska 68117. Employees were exposed to cave in hazards in that employees were working on the West side of trench that did not contain any cave- in protection. The West side of the trench exceeded depths of 7 feet 4 inches. TAB Holding Company was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.652(a)(1), which was contained in OSHA inspection number 1727240, citation number 1, item number 1 and was affirmed as a final order on 4-19-24, with respect to a workplace located at 655 North 108th Ave, Omaha, Nebraska 68154.
