29 CFR  1926.300(b)(3): One or more methods of machine guarding was not provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks:  106 Emerald St, Broomfield CO: On or about July 30, 2025, the company's 4.5-inch Makita right angle hand grinder was used without an affixed guard. Employees using the unguarded hand grinder were not protected from hazards created by flying chips and sparks and/or struck-by hazards from the abrasive wheel if it were to break.

29 CFR  1926.651(c)(2): A stairway, ladder, ramp or other safe means of egress was not located in trench excavations that were 4 feet (1.22m) or more in depth so as to require no more than 25 feet (7.62m) of lateral travel for employees:  106 Emerald St, Broomfield CO: On or about July 30, 2025, the employer routinely fails to assure that employees have a stairway, ladder, ramp, or other safe means of egress located in trench excavations that were 4 feet or more in depth. Employees were in vertical trench that measured to be approximately 5 feet 6 inches deep by 16 feet long by 2 feet wide without any protection. This exposed employees to cave in and struck by hazards.

29 CFR  1926.651(k)(1):An inspection of the excavations, the adjacent areas, and protective systems was not conducted by the competent person prior to the start of work and as needed throughout the shift:  106 Emerald St, Broomfield CO: On or about July 30, 2025, the employer routinely fails to ensure that a competent person performs daily inspections of excavations, spoil piles, egress, and adjacent areas. This condition exposed employees to cave-in hazards and to the hazards of being struck by falling materials.

29 CFR  1926.651(j)(2): Protection was not provided by placing and keeping excavated or other materials or equipment at least 2 feet (.61m) from the edge of excavations, or by the use of retaining devices that were sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary:  DBS, Inc. DBA Colorado Structural Repair: The employer is failing to ensure that excavated materials are removed from the edge prior to employees entering to work inside the trench. This violation was most recently observed on July 30, 2025, at 106 Emerald Street in Broomfield Colorado where employees were not protected from cave-ins caused by a spoil pile bearing weight on the edge of a trench that was approximately 5 feet 6 inches deep. To abate this violation, the employer must ensure that its employees' performing trenching and excavation work are protected from falling soil and rock, and that no employee is allowed into a trench or excavation without first ensuring that are above the employee is free from falling rock and soil.   DBS, Inc. dba Colorado Structural Repair was previously cited for a violation of this occupational safety and health standard, which was contained in OSHA inspection number 1678255, citation number 3, item number 2, was affirmed as a final order on December 8, 2023, with respect to a workplace located at 4500 Meadow Drive, Vail CO.   DBS, Inc. dba Colorado Structural Repair was previously cited for a violation of this occupational safety and health standard, which was contained in OSHA inspection number 1483881, citation number 3, item number 2, was affirmed as final order on January 6, 2021, with respect to a workplace located at 9276 Desert Willow Rd., Highlands Ranch CO.

29 CFR  1926.652(a)(1):Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652 (b) or (c):  DBS, Inc. DBA Colorado Structural Repair: The employer is failing to protect each employee performing work in trenching by properly sloping or benching the trenches or using appropriate protective systems designed in accordance with paragraph (b) or (c) of 29 CFR 1926.652. This violation was committed on July 30, 2025, at 106 Emerald Street in Broomfield Colorado when employees were conducting foundation repairs on a residential home in a trench that was approximately 5 feet 6 inches deep in type B soil, without a protective system. To abate this item the employer must ensure that the trenches are properly slopes, or that protective systems designed in accordance with this standard are used, and that no employees enter trenches until this protection is provided.   106 Emerald St, Broomfield CO: On or about July 30, 2025, the employer routinely fails to assure effective protection against cave in hazards while conducting foundation repairs on a residential home.
