29 CFR  1926.20(b)(2): The employer did not initiate and maintain programs which provided for frequent and regular inspections of the job site, materials and equipment to be made by a competent person(s).  On or about July 31, 2025, at the worksite located at 305 E. Spring St., Saint Marys, Ohio: The employer did not ensure an accident prevention program was developed and implemented for the work environment, to include regular inspections of the job site conducted by a competent person.  Employees performing tasks associated with temporary shoring of the multi-story building and excavation of the foundation were exposed to struck-by and crushing hazards when performing demolition and construction work.  No additional abatement information is needed for this item.

29 CFR  1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury.  On or about July 31, 2025, at the worksite located at 305 E. Spring St., Saint Marys, Ohio: The employer did not instruct employees in the recognition and avoidance of unsafe conditions related to temporary shoring and supporting a multi-story building. Employees were tasked to remove a section of the south wall, install temporary shoring and headers, and excavate the foundation in preparation for footers to transfer the building loads to shoring systems. Employees were not instructed in the means and methods for building and installing a temporary shoring system, in the recognition and avoidance of unsafe conditions related to demolition work, in monitoring methods to ensure the stability of the building during demolition and construction work, or to identify and detect hazards resulting from weakened walls or floors. The condition exposed employees to struck-by and crushing hazards.  No additional abatement information is needed for this item.

29 CFR  1926.850(a): An engineering survey was not performed by a competent person to determine the conditions of the framing floors and walls and the possibility of unplanned collapse of any portion of the structure prior to permitting employees to start demolition operations.  On or about July 31, 2025, the employer did not ensure an engineering survey was conducted and recorded by a competent person prior to beginning demolition work on the supporting structures of the mixed-use building located at 305 E. Spring St. in St. Marys, Ohio.  Employees who worked to remove and excavate sections of the foundation, a section of the south exterior wall, and/or installed jack posts were exposed to being struck and/or crushed by falling building materials in that one employee sustained fatal crushing injuries and another employee sustained facture injuries when a portion of the building's west exterior wall collapsed.  No additional abatement information is needed for this item.
