29 CFR 1910.1200(e)(1): Employer had not developed or implemented a written hazard communication program that included the requirements outlined in 29 CFR 1910.1200(e)(1)(i) and (e)(1)(ii): At the construction site located at 118 W Walnut Street in Raymore, Missouri 64083, on or about July 23, 2025, and at times prior: Employees performing masonry work were exposed to hazardous dust from working with bricks and cement mixture containing respirable crystalline silica. The employer had not developed or implemented a written hazard communication program to train employees in the safety and health hazards, precautions, emergency response and safety data sheet information for all the chemicals and processes used in the workplace including respirable crystalline silica dust.

29 CFR 1926.1153(c)(1): For each employee engaged in a task identified on Table 1, the employer did not fully and properly implement the engineering controls, work practices, and respiratory protection specified for the task on Table 1, unless the employer assesses and limits the exposure of the employee to respirable crystalline silica in accordance with paragraph (d) of this section. At the construction site located at 118 W Walnut Street in Raymore, Missouri 64083, on or about July 23, 2023, and at times prior: Employees performing masonry work were exposed to asthma, COPD, and permanent lung damage, associated with respirable crystalline silica dust, while dry cutting bricks using saws that were not equipped with integrated water delivery system that continuously feeds water to the blade.
