29 CFR 1926.501(b)(13):  Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):   (a)  920 Duke Street, Lebanon, PA:  On or about August 15, 2025, employees worked on the roof of a residential structure in excess of 9 feet above grade with no fall protection system in place.  Burgos Pineda Roofing and Siding was previously cited for a violation of this Occupational Safety and Health Standard 29 CFR  1926.501(b)(13), which was contained in OSHA inspection number 1760953, citation number 1, item number 1 and was affirmed as a final order on September 24, 2024, with respect to a workplace located at 727 S Newberry Street, York, PA.  Abatement certification and documentation required within 10 days after abatement date. The certification shall include a statement that abatement is complete, the date and method of abatement, and state that employees and their representatives were informed of this abatement. Abatement documentation shall include documents demonstrating that abatement is complete, such as evidence of the purchase or repair of equipment, photographic or video evidence of abatement or other written records.

29 CFR  1926.1053(b)(1):Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:  (a)  920 Duke St, Lebanon, PA:  On or about August 15, 2025 employees worked on the roof of a residential structure in excess of 9 feet above grade utilizing an extension ladder to gain access that was not set up with the side rails extending 3 feet above the landing surface (roof edge).  Burgos Pineda Roofing and Siding was previously cited for a violation of this Occupational Safety and Health Standard [29 CFR  1926.1053(b)(1)], which was contained in OSHA inspection number 1760953, citation number 1, item number 2 and was affirmed as a final order on September 24, 2024, with respect to a workplace located at 727 S Newberry Street, York, PA.  Abatement certification and documentation required within 10 days after abatement date.
