OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to crushed-by hazards:  On or about August 14, 2025, at the warehouse; employees utilized forklifts, exposing them to crushed-by hazards from a forklift tip-over while transporting tires in the yard.

29 CFR  1910.178(n)(15): 29 CFR 1910.178(n)(15):  While negotiating turns, speed was not reduced to a safe level by means of turning the hand steering wheel in a smooth, sweeping motion. Except when maneuvering at a very low speed, the hand steering wheel was not turned at a moderate, even rate:  On or about August 14, 2025, at the warehouse; employees operated a forklift at speeds not safe to negotiate turns while transporting tires.
