On or about August 21st, 2025, employees engaged in trenching operations located at 6417 North 168th Ave, Bennington, Nebraska 68007 were exposed to struck-by hazards in that various tools such as hammers, wrenches, pipes, buckets, saws, and containers of PVC glue were within 1 to 5 inches from the edge of the trench.

29 CFR  1926.651(k)(2): Where there was evidence of a situation that could result in a possible cave-in or other hazardous condition the competent person did not remove exposed employees until necessary precautions could be taken to ensure their safety.   On or about August 21st, 2025, employees engaged in trenching operations located at 6417 North 168th Ave, Bennington, Nebraska 68007, were exposed to cave-in hazards in that an employee was observed working inside an unprotected trench, at depths that exceeded 5 feet.  The trench contained visible fissuring located on the Northwest side directly in front on the excavator.

On or about August 21st, 2025, employees engaged in trenching operations located at 6417 North 168th Ave, Bennington, Nebraska 68007, were exposed to cave-in hazards in that the employer failed to ensure that the written tabulated data for trench were on the job site and readily available for employees to utilize.

29 CFR  1926.1053(b)(15):Ladders were not inspected by a competent person for visible defects on a periodic basis and after an occurrence that could affect their safe use:  On or about August 21st, 2025, employees engaged in trenching operations located at 6417 North 168th, Ave, Bennington, Nebraska 68007, were exposed to fall and puncture hazards in that employees were using a damaged ladder to get in and out of the trench. The ladder was bent on both vertical rails and the ladder also contained sharp protruding edges.
