OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: a) At the facility, including but not limited to areas around the Hendrick saw, Tiger saw, and EB-90 saw, on or about August 21, 2025, employees were exposed to fire, explosion, and deflagration hazards. These hazards were present during woodworking operations, such as saw cutting, which generated combustible dust.

29 CFR 1910.22(a)(1): The employer did not ensure that all places of employment, passageways, storerooms, service rooms, and walking-working surfaces are kept in a clean, orderly, and sanitary condition. a) At and around the Hendrick saw dust collection system: On or about 8/21/2025 and times prior, the employer exposed all employees within the facility to fire hazards in that sawdust accumulation covered floors, walls, ceilings, ledges, and overhead fixtures, measuring up to approximately 14 inches at the deepest point. b) At and around the Tiger saw dust collection system: On or about 8/21/2025 and times prior, the employer exposed all employees within the facility to fire hazards in that sawdust accumulation covered floors, walls, ceilings, ledges, and overhead fixtures, measuring up to approximately 6 inches at the deepest point. c) At and around the EB-90 saw dust collection system: On or about 8/21/2025 and times prior, the employer exposed all employees within the facility to fire hazards in that sawdust accumulation covered floors, walls, ceilings, ledges, and overhead fixtures, measuring up to approximately 4 inches at the deepest point.
