29 CFR 1910.95(c)(1):The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.9(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent: On or about August 25, 2025 in the corn shucking area, employees were exposed to continuous noise at a dose of 82.4% (8-Hour Time Weighted Average sound level of 85 dBA) during the 410 minute sampling period. For a full eight-hour work shift, this exposure is equivalent to an average sound level of 89.5 dBA.

29 CFR 1910.95(i)(2):The employer did not ensure that hearing protectors were worn by employees who were exposed to an 8-hour TWA of 85 decibels or greater: On or about August 25, 2025 in the corn shucking area, employees performing corn processing and packing were not required to wear hearing protectors in the hazardous noise environment.
